§ 1. Operator and contact
- The operator and owner of the website be here. available at https://behere.info, and also the owner of the "be here" brand, is MD ELEVATE LTD, 22 Railway Street, Chatham, England, ME4 4JT, United Kingdom, company number 16589932 ("Operator").
- The primary contact point for the Operator for users, including in technical, complaint-related, content-related, privacy and personal data protection matters, is: contact@behere.pl.
- The Operator's legal representative in the European Union is Marta Duczman, e-mail: marta@behere.info.
- The representative's details are published and updated to the extent required by directly applicable European Union law.
- The ownership and organisation of MD ELEVATE LTD as a company are governed by the law applicable to the company. The provision of services to users in the European Union is also subject to applicable directly applicable European Union law and applicable national law.
§ 2. Definitions
- Service - the behere.info website, its subpages, the Facilitator panel and related functionalities made available by the Operator.
- User - any person using the Service.
- Participant - a User browsing Events or submitting a request to take part in an Event.
- Facilitator - a natural person, legal person or other entity permitted to create an Account and publish a Profile or Events.
- Account - an individual Facilitator account in the Service.
- Profile - a Facilitator's personal or business subpage presented in the Service.
- Event - a circle, group, meeting, workshop, developmental or therapeutic event, or other activity published in the Service.
- Subscription - paid or promotionally free access to functions requiring an active plan.
- Billing Period - the period for which a Subscription fee is paid in advance, in accordance with the Price List.
- Content - text, photo, graphic, review, material, information about a Profile or Event, or other information provided by a User.
- Price List - current information on prices and the scope of paid plans made available to the Facilitator before activation of a paid Subscription.
- DPA - the data processing agreement constituting Annex 1 to the Terms, applied solely to the extent that the Operator acts as a data processor on behalf of the Facilitator.
§ 3. Nature and scope of the Service
- be here. is an informational and search platform and an online intermediation service used in particular to search for Events and Facilitators, present Profiles and forward submissions from persons interested in taking part.
- As a rule, the Operator is not the organiser of Events published by Facilitators, does not provide the services offered by Facilitators, and is not a party to the agreement concerning participation in an Event, unless expressly stated otherwise for a given Event.
- The price of participation, payment rules, cancellation, refunds, safety and performance of the Event are determined by the relevant Facilitator or organiser. If the Facilitator acts as a trader towards a consumer, it is responsible for performing its own consumer obligations.
- The submission form in the Service serves to communicate interest in participation. Sending the form alone does not guarantee a place and does not mean an agreement to participate has been concluded, unless expressly stated otherwise for a specific Event.
- The Operator may develop the Service with additional functions. If a new function changes the nature of the transaction, the payment rules or the Operator's role, the User will receive appropriate information before using it.
§ 4. Technical requirements and security rules
- Using the Service requires a device with Internet access, a current browser supporting standard web technologies and, for Account functions, an active e-mail address.
- The Facilitator is responsible for keeping login data confidential and should not share the Account with unauthorised persons.
- A User may not take actions disrupting the operation of the Service, circumvent safeguards, attempt unauthorised access, introduce malicious code, or automatically harvest data in a way that excessively burdens the Service.
- The Operator may carry out technical and security works causing temporary unavailability of some functions.
§ 5. Facilitator registration and conclusion of the Agreement
- Creating an Account requires providing the required data, undergoing any verification, and accepting the Terms.
- Upon successful creation of the Account, an agreement for the provision of electronic services ("Agreement") is concluded between the Facilitator and the Operator for an indefinite period.
- The Agreement is concluded electronically and does not require a separate handwritten signature. The Operator enables the Terms to be reviewed, saved and reproduced before the Agreement is concluded.
- The Facilitator receives, at the e-mail address provided, information confirming the creation of the Account or other durable information about the conclusion of the Agreement.
- The Facilitator Account is intended for a person or entity using the Service in connection with its professional, business, commercial or other organised activity consisting of offering Events or services.
- The mere fact of holding an Account does not mean that the Operator has confirmed fulfilment of all legal requirements applicable to the Facilitator's activity.
§ 6. Facilitator verification
- The Operator may make publication of a Profile or selected markings conditional on carrying out verification, including, among others, a form, a conversation, checking submitted documents or publicly available information.
- The Facilitator is responsible for the truthfulness, accuracy and completeness of the data provided during verification.
- The "verified" marking means solely that the Operator has carried out the procedure described in the Publication and Verification Rules. It does not constitute state accreditation, a licence, a recommendation, or a guarantee of quality, safety or result.
- The Operator may request re-verification or an update of documents if justified by a change in data, the passage of time, a report, or a risk to users.
§ 7. Free period and Subscription model
- Until 31 December 2026, functions covered by the Subscription are made available to Facilitators free of charge on a promotional basis.
- Each newly created Account additionally receives 3 months of free access to subscription functions, counted from the date the Account is activated.
- If these periods overlap, free access continues until the later of the two dates: 31 December 2026 or the date falling 3 months after Account activation. The periods do not add up in any other way.
- The end of the free period does not in itself create a payment obligation. A paid Subscription begins only after it is activated by the Facilitator.
- The Subscription operates on a prepaid model: the fee is due in advance for the next Billing Period, and paid functions are available only during the free or paid period.
- If the Facilitator enables automatic renewal, the Operator or payment provider may collect the fee for the next period in advance. The Facilitator may disable automatic renewal at any time, without a notice period and without an additional fee.
- Disabling automatic renewal does not shorten an already paid period. Paid functions remain active until its end.
- If the next fee is not collected or the Facilitator does not renew the Subscription, the next Billing Period does not begin, no charge arises for the inactive period, and functions requiring an active Subscription are disabled.
- The fee for a Billing Period that has already begun is, as a rule, not subject to a proportional refund solely because the Facilitator disabled renewal, unless a refund obligation results from mandatory law or from a separate offer by the Operator.
§ 8. The Account after the Subscription ends
- Disabling or not renewing the Subscription does not mean termination of the Agreement, deletion of the Account, or automatic removal of the Profile.
- After the free or paid access ends, the Facilitator's Profile may remain publicly available in the Service.
- The Facilitator retains access to the Account with respect to functions available without an active Subscription, but loses the ability to use functions marked as paid, in particular the ability to add new Events.
- Content and Events published before the end of the Subscription may remain visible in accordance with their term, status and the Service's functionality.
- Re-activating the Subscription restores functions covered by the chosen plan, provided the Account has not previously been terminated or suspended.
§ 9. Price List and payments for the Operator's services
- Prices, taxes, the length of the Billing Period and the scope of the plan are presented to the Facilitator before activation of a paid Subscription.
- Payments may be handled by an external payment operator. In that case, some payment data is transferred directly to that provider in accordance with its terms.
- The Operator may introduce new plans and change the Price List for future periods, while observing the rules on changing terms towards business users.
- A price change does not affect a Billing Period that has already been paid for.
§ 10. Publishing Profiles and Events
- The Facilitator may publish only information that is lawful, true, current and does not infringe the rights of third parties.
- The Facilitator is responsible in particular for the description, price, date, place and nature of the Event, the qualifications stated in the Profile, the rules of participation, safety, settlements and the compliance of its own activity with the law.
- Content concerning health, therapy, psychology, psychotherapy or other regulated services may not suggest entitlements, therapeutic properties or guaranteed results without a proper basis.
- Detailed criteria are set out in the Publication and Verification Rules available in the Service.
§ 11. Participant submissions
- A Participant may, via the Service, send the Facilitator a submission concerning a specific Event.
- The Operator handles the submission technically and forwards it to the relevant Facilitator. After receiving the submission, the Facilitator is responsible for further contact, organising participation and its own data processing.
- A Participant should not include in the ordinary message field data concerning health, diagnosis, treatment, sexuality, religious beliefs or other special category data unless this is necessary.
- If the nature of a specific Event means the submission may include special category data, the Service may, before the submission is sent, require an additional statement or explicit consent.
- The Facilitator may use panel functions serving to handle submissions. To the extent the Operator stores data on behalf of the Facilitator as a processor, the DPA applies.
§ 12. Ranking and presentation of results
- The order of results may depend on relevance to the User's search and filters, location, Event date, recency, category, completeness of data and other parameters described in the Service's interface.
- The Service may present content selected editorially because of its topic, timeliness or usefulness.
- If the Operator enables paid promotion of a Profile or Event affecting ranking, such content will be marked as promoted, sponsored or advertising.
- The Operator may develop the ranking algorithm while maintaining the transparency required by law towards business users.
§ 13. Reviews
- The Operator may use mechanisms to link a review to a submission or participation, e.g. an individual link sent after the Event.
- Marking a review as "verified" means only that a particular mechanism linking the author to the Event was applied; it does not mean confirmation of the truthfulness of all the author's assessments and statements.
- Fictitious, purchased reviews, reviews posted by the Facilitator in its own name, mass generated reviews, or reviews that infringe the law, privacy or the confidentiality of the meeting, are prohibited.
- A review is not removed solely because it is critical. It may be restricted or removed for the reasons set out in the Terms and the Publication Rules.
§ 14. Rights to Content
- The Facilitator retains the rights to the Content it publishes and represents that it holds the rights necessary for its lawful use.
- By publishing Content, the Facilitator grants the Operator a non-exclusive, royalty-free, territorially unlimited licence to record, technically process, display and make it available to the extent necessary to operate the Service, the Profile, the Event and their promotion in the Operator's channels.
- The licence lasts for the period the Content is published and for the period technically necessary to remove it from backup copies.
- The Facilitator is responsible for having an appropriate basis for publishing the image and data of third parties.
§ 15. Prohibited content and moderation
- It is prohibited to provide Content that is unlawful, infringes the rights of third parties, is misleading, incites violence or prohibited acts, contains illegal offers, malicious software, spam, or other Content prohibited under the Publication Rules.
- The Operator may moderate Content manually and using technical tools. The Operator does not assume a general obligation to monitor all information published in the Service.
- Content considered unlawful may be reported to contact@behere.pl, indicating the specific Content or URL and the justification.
- The Operator handles reports in a timely, diligent, objective and proportionate manner.
- In cases required by law, the Operator provides the reasoning behind a decision restricting Content or a service, together with information on how to challenge it.
§ 16. Restriction, suspension and termination of service provision
- The Operator may restrict or suspend a given function, Profile, Event or Account, among others due to a breach of law or the Terms, providing false data, a security threat, fraud, spam, infringement of third-party rights, or lack of required qualifications.
- In choosing a measure, the Operator takes into account the nature and severity of the breach, its effects, frequency, the possibility of remedying it, and the risk to Users.
- Towards a Facilitator who is a business user, the Operator provides the reasoning for a restriction or suspension on a durable medium before it is applied or, at the latest, at the moment it is applied, where required by applicable law.
- If the Operator decides to fully terminate the provision of online intermediation services towards a business user, it generally provides the reasoning on a durable medium at least 30 days before the service provision ends.
- This period does not apply where applicable law allows for immediate termination, in particular in connection with a legal obligation, an overriding security threat, or repeated breach of terms.
- The Facilitator may request a review of the decision at contact@behere.pl.
§ 17. Cancellation of the Subscription and termination of the Agreement by the Facilitator
- Cancelling automatic renewal of the Subscription applies only to future paid periods and does not terminate the Agreement.
- The Facilitator may fully terminate the Agreement at any time, without a notice period, by using the Account deletion function or by submitting an unambiguous statement to the Operator.
- Termination of the Agreement leads to deactivation of the Account and Profile, subject to periods for technical data deletion, statutory obligations and backup copy rules.
- Before terminating the Agreement, the Facilitator should download the data it needs and to which it is entitled.
§ 18. Complaints
- Complaints regarding the functioning of the Service may be sent to contact@behere.pl.
- A complaint should contain information allowing identification of the problem, the Account or the relevant function, and contact details enabling a reply.
- The Operator handles a complaint without undue delay, as a rule within 14 days.
- Complaints concerning the course of an Event, its cancellation, participation fees or the quality of a service provided by the Facilitator should be directed straight to that Facilitator.
§ 19. Liability
- The Operator is liable for its own provision of electronic services under applicable law.
- The Operator is not liable for the performance of the agreement between a Participant and a Facilitator, the course of an Event, qualifications not disclosed or falsely presented by a Facilitator, or the consequences of decisions made by a User on the basis of a Facilitator's Content, subject to liability that cannot be excluded.
- Verification of a Facilitator reduces informational risk but does not constitute a guarantee of results or of the safety of a specific Event.
- Circles, developmental meetings and support groups do not replace medical, psychological, psychotherapeutic help or crisis intervention, unless a specific service is actually provided as an appropriate professional service by an authorised person.
- No provision of the Terms limits liability to the extent that such a limitation would be void or impermissible.
§ 20. Personal data
- The rules for the Operator's processing of personal data as a controller are described in the Privacy Policy.
- The rules for using cookies and similar technologies are described in the Cookies Policy.
- To the extent the Operator processes data on behalf of the Facilitator as a processor, the DPA (Annex 1) applies.
- The Facilitator, as an independent controller, is responsible for the compliance of its own processing of participants' data with applicable law, including information obligations and appropriate legal bases.
§ 21. Changes to the Terms
- The Operator may amend the Terms for valid reasons, in particular due to changes in law, functionality, the payment model, security requirements, technology providers, or the need to counter abuse.
- Material changes are communicated to Facilitators on a durable medium or by electronic means.
- Towards business users, proposed changes to terms are, as a rule, communicated at least 15 days before they take effect.
- Changes do not operate retroactively, unless required by law or more favourable to the Facilitator.
§ 22. Governing law and final provisions
- The Agreement with the Operator is governed by the law of England and Wales to the extent the parties may make a choice of law. This choice does not exclude directly applicable European Union law or other mandatory rules.
- If a User benefits from consumer protection, the choice of law does not deprive it of the protection granted by provisions that cannot be excluded by agreement.
- The invalidity of a single provision does not affect the validity of the remaining part of the Terms.
- The Terms are effective from 30 August 2026 or from the date of later publication in the Service.
